The website tracialand.ro is administered by ASOCIATIA EUROPEANA PENTRU PROMOVAREA TURISMULUI SI A TRADITIILOR „TRACIA LAND”, a non-governmental, independent and apolitical organization, hereinafter referred to as “TraciaLand”, “the Association”, “we” or “the site operator”.

2. Purpose of the website
The website tracialand.ro serves a presentation, information, promotion and public communication role regarding TraciaLand's activity, including projects, events, initiatives, festivals, cultural programmes, activities promoting tourism, agrotourism, regional products, local gastronomy, crafts, traditions, alternative education and cultural heritage.
The website may contain information about members, partners, founders, projects, events, collaboration opportunities, ways of joining, contact forms, promotional materials and other information relevant to the Association's activity.
3. Definitions
In this document, the terms below shall have the following meaning:
Site means the website available at tracialand.ro, together with its pages, subpages, content, images, forms, materials and available functionalities.
User means any natural or legal person accessing or using the site.
Member means the natural person, legal person, organization, institution or entity that joins or intends to join TraciaLand, in accordance with the Association's internal procedures.
Content means any text, image, graphic, logo, video material, audio material, document, description, form, article, poster, information or other material published on the site.
Services means the information, promotion, communication, contact facilitation, project presentation, event presentation or initiative presentation activities available through the site.
4. Acceptance of the Terms and Conditions
Use of the site implies full acceptance of these terms. The Terms and Conditions apply to all users, regardless of whether they access the site occasionally, request information, submit a form, wish to become members or interact with TraciaLand in any other way.
TraciaLand reserves the right to amend this document whenever necessary. The updated version will be published on the site and will take effect from the date of publication, unless otherwise stated.
5. Nature of the published information
The information available on tracialand.ro is of a general, informative and presentation nature. It does not constitute a firm contractual offer, unless this is expressly stated.
TraciaLand makes efforts to ensure that the information published is correct, up to date and relevant. However, delays, material errors, changes to programmes, partnerships, events, event dates or participation conditions may occur. For official confirmations, users are requested to contact the Association by e-mail.
6. Joining TraciaLand
The site may contain information regarding the possibility of joining TraciaLand or collaborating with the Association.
Submission of a membership request, form or collaboration request does not automatically confer member status and does not guarantee acceptance of the request. Membership is granted in accordance with the Association's statute, internal regulations, decisions of the competent bodies and the documents applicable on the date of the request.
TraciaLand reserves the right to assess each request based on the Association's objectives, the compatibility of the applicant's activity with the promoted fields, compliance with the cultural and professional values of the cluster and the existence of the required documents.
7. Events, projects and promoted activities
TraciaLand may publish on the site information about events, festivals, fairs, exhibitions, workshops, cultural programmes, European projects, educational projects, promotion campaigns or other activities.
Dates, locations, schedules, guests, partners, participation conditions and other details may be changed for organizational, technical, administrative, financial, security, weather-related or force majeure reasons, or for other reasons beyond the Association's control.
If special participation rules apply to certain events, they will be communicated separately through dedicated pages, forms, regulations, contracts, invitations or informative materials.
8. Regional products, tourism services and promotion
TraciaLand may present, promote or facilitate the visibility of local producers, artisans, tourism operators, service providers, cultural organizations, local communities or partners.
Unless expressly stated otherwise, TraciaLand is not the seller of products or services presented by third parties and is not liable for the quality, conformity, delivery, availability, price, warranty, safety or legality of the products and services offered directly by them.
Any contractual relationship between the user and a producer, tourism operator, artisan, provider, member or partner is conducted directly between those respective parties. TraciaLand may have a role in promotion, communication, cultural intermediation or contact facilitation, without becoming a party to the contracts concluded between users and third parties, unless this is expressly stated.
9. Permitted use of the site
Users may access the site for information, research, contacting the Association, reviewing projects, submitting requests, expressing interest in membership or collaboration and participating in public activities.
Use of the site for illegal, fraudulent, abusive, defamatory, discriminatory, unauthorized commercial purposes or in ways that may affect the image, operation, security or integrity of TraciaLand is prohibited.
In particular, unauthorized access attempts, insertion of malicious code, cyberattacks, automated copying of content, use of a false identity, sending spam messages or using the site to promote products, services or ideologies contrary to the law or the values of the Association are prohibited.
10. Intellectual property
The content published on tracialand.ro, including the name TraciaLand, logos, texts, images, graphic elements, presentation materials, concepts, the site structure and communication materials, belongs to TraciaLand or, where applicable, its partners/licensors.
Users may not copy, reproduce, distribute, modify, publish, transmit, use commercially or exploit the site's content without TraciaLand's prior written consent, except for reasonable use for personal, informational or journalistic purposes, with indication of the source.
Reproduction of short excerpts is permitted only with clear mention of the source and an active link to tracialand.ro if the reproduction takes place online.
11. Materials submitted by users
If users submit texts, images, documents, proposals, project descriptions, data about products, services, events or other materials, they declare that they are entitled to submit those materials and that they do not infringe the rights of third parties.
By submitting materials to TraciaLand, the user grants the Association the right to analyze, store and use them for communication purposes, assessment of the request, promotion of joint activities or project documentation, within the limits of the purpose for which they were submitted.
TraciaLand reserves the right to refuse publication of or remove any material that is incomplete, incorrect, offensive, illegal, irrelevant, contrary to the Association's values or liable to affect its reputation.
12. Links to third-party websites
The site may contain links to websites of partners, members, public institutions, social media platforms, cultural projects or other third parties.
TraciaLand does not control and does not guarantee the content, policies, security, availability or practices of third-party websites. Accessing these links is done at the user's own responsibility.
If unauthorized, suspicious, irrelevant or potentially harmful links appear on the site, users are asked to notify the Association at office@tracialand.ro.
13. Accounts, forms and communication
The site may provide contact, registration, membership application, information request or event participation forms.
Users are required to provide real, accurate, complete and up-to-date information. TraciaLand is not liable for the inability to respond to a request caused by the provision of incorrect or incomplete data.
Submission of a form does not oblige TraciaLand to accept the request, confirm participation in an event, approve membership or conclude a partnership.
14. Protection of personal data
TraciaLand processes personal data in accordance with the applicable legislation, including Regulation (EU) 2016/679 on the protection of personal data, known as the GDPR.
Data may be processed for communication, responding to requests, managing the relationship with members, organizing events, carrying out projects, sending notices, fulfilling legal obligations or defending the rights and legitimate interests of the Association.
More information regarding the data collected, the purposes of processing, the legal bases, the storage period and the rights of data subjects must be included in a separate Privacy Policy available on the site.

15. Cookies

16. Limitation of liability
TraciaLand does not guarantee that the site will operate continuously, without interruptions, errors, technical vulnerabilities or incompatibilities with certain devices, browsers or systems.
The Association is not liable for losses, damages, costs or inconveniences caused by use of the site, temporary inability to access it, technical errors, cyberattacks, content transmitted by third parties or decisions made by users exclusively on the basis of the information published on the site.
TraciaLand is not liable for the economic, professional, commercial, tourism-related or cultural activity carried out independently by members, partners, producers, artisans, operators or organizations promoted on the site.
17. Obligations of users
Users undertake to use the site in good faith, in accordance with the law, this document and the legitimate rights of TraciaLand and of third parties.
Users shall not transmit false information, illegal materials, offensive content, data belonging to other persons without authorization, unsolicited messages, infected files or any content that may affect the functioning of the site or the reputation of the Association.
18. Suspension of access
TraciaLand reserves the right to restrict, block or suspend a user's access to the site or to certain functionalities, without prior notice, if there are indications of abusive, fraudulent, illegal use or use contrary to these terms.
19. Official communications
Official communications to TraciaLand shall be sent to the e-mail address office@tracialand.ro or through other channels expressly communicated on the site.
Communications sent through social networks, informal messages or public comments are not considered official notices, unless TraciaLand expressly confirms their receipt and acceptance.
20. Force majeure and fortuitous event
TraciaLand is not liable for non-performance or delayed performance of obligations caused by events beyond its reasonable control, including natural disasters, conflicts, epidemics, administrative restrictions, internet disruptions, cyberattacks, technical failures, legislative changes, strikes, event cancellations or other similar situations.
21. Applicable law
This document is governed by Romanian law.
Any misunderstanding arising between users and TraciaLand shall, as far as possible, be settled amicably. If amicable settlement is not possible, disputes shall be submitted to the competent courts in Romania, in accordance with the applicable legislation.
